Celeste Systems Corp., doing business as BalanceGuru (“BalanceGuru,” “we,” “our,” or “us”)

Welcome to BalanceGuru. These Terms of Use ("Terms") govern your access to and use of the BalanceGuru website, the BalanceGuru mobile application (the "App"), and any beta or early-access program we make available (collectively, the "Services"). By accessing the website, downloading or using the App, or participating in a beta program, you agree to these Terms. If you do not agree, please do not use the Services.

Website and App Purpose

BalanceGuru provides information, products, and services related to healthy aging and fall risk reduction. The App allows users to perform guided exercises while their device camera is used to track body movement, for the purpose of exercise scoring, feedback, and progress tracking.

No Medical Advice; Wellness and Exercise Use

BalanceGuru — including any scores, feedback, assessments, or recommendations generated by the App — is intended to support exercise, healthy aging, balance awareness, and general wellness. It is not intended to provide a medical diagnosis, replace professional medical evaluation or treatment, or be relied upon for medical decision-making. Always consult a qualified healthcare professional regarding medical conditions and before beginning an exercise or fall-prevention program when appropriate.

The Beta Program

If you are participating in a BalanceGuru beta cohort:

The App is provided in a pre-release, "as is" state. Features, scoring, and availability may change or be discontinued without notice.
We do not guarantee the beta program, or any specific feature, will continue for any particular length of time.
You may withdraw from the beta program at any time by discontinuing use of the App and contacting us at the email below.
Feedback, usage data, and movement/landmark data collected during the beta may be used to develop, validate, and improve BalanceGuru's exercises, scoring algorithms, and future versions of the App. See our Privacy Policy for details on what is collected and how it is used.
The App and beta program are intended for adult users. If you are assisting an older adult with setup or use of the App on their behalf, you confirm you are authorized to do so.

Camera and Movement Tracking

The App uses your device's camera to observe body movement while you perform exercises. The App does not record, store, or transmit photos or video of you. Instead, your device converts what the camera sees into a set of numeric body-position points (a "stick figure" style skeletal representation), and only this landmark data — not any image or video — is sent to and stored on our servers. See our Privacy Policy for full detail on this data and your rights regarding it. Using the App's exercise-tracking features means you consent to this camera-based tracking as described.

Intellectual Property

All content on the website and in the App, including text, graphics, logos, images, exercise content, scoring methodology, and trademarks, is owned by or licensed to BalanceGuru / Celeste Systems Corp. and may not be copied, reproduced, modified, distributed, or used without our prior written permission, except as permitted by law.

Acceptable Use

You agree not to:

Use the Services for unlawful purposes
Attempt to gain unauthorized access to the website, App, or their underlying systems
Interfere with the operation or security of the website or App
Upload or transmit malicious code, spam, or harmful content
Reverse-engineer, decompile, or attempt to extract the source code, models, or scoring algorithms of the App
Use any information or content from the Services in a way that violates applicable law
Use the App in a manner inconsistent with its guided-exercise instructions or recommendations, including intentionally performing exercises, repetitions, or difficulty levels beyond those recommended by the App, or using the App in an unsafe physical environment

User Submissions

If you submit information through our contact form, App account registration, or otherwise provide content to us, you represent that the information you provide is accurate to the best of your knowledge and that you have the right to submit it. Submissions through our website contact form may be processed by Jotform and its service providers.

Third-Party Links

The website and App may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of those third parties.

Disclaimer of Warranties

The website and App are provided on an "as is" and "as available" basis. We make no warranties or representations regarding the accuracy, completeness, reliability, security, or availability of the Services or their content, including the accuracy of any exercise scoring or feedback.

Limitation of Liability

To the fullest extent permitted by law, BalanceGuru, Celeste Systems Corp., and their owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the website, App, or beta program, including any injury resulting from performing exercises guided by the App.

Changes to These Terms

We may update these Terms of Use from time to time. Changes will be posted on this page with an updated effective date. Material changes affecting the App or beta program will also be communicated in-app where practicable.
